New DNA Testing in Texas Case of Possibly Innocent Man Already ...

CNN has more on this developing story. After nearly eight months of deliberation, Judge Paul Murphy ruled on June 11 that Jones' father Claude, executed in 2000 for the murder of a Point Blank, Texas, liquor-store owner, should have another day in court. Specifically, that the only physical evidence linking Jones to the crime — a one-inch piece of hair that somehow survived a destruction order years ago — had to be preserved, against the wishes of San Jacinto County, and transferred to an independent forensics laboratory for DNA testing that wasn't available during the original trial. Judge Orders DNA Test of 1-Inch Hair That Led to Texas Man's ...

Claude Howard Jones was executed a decade ago. But a DNA test is now going to be conducted to determine whether a 1-inch hair that was relied on to convict him of capital murder was actually his. A retired Texas appellate judge hearing a Dallas case seeking to prove that Jones was wrongfully convicted ruled Friday that the DNA test would be performed, despite opposition from the San Jacinto County District Attorney's office. which argued that a jury verdict should be final, reports the Associated Press. Local and statewide experts, even a former Houston police chief, insist HPD should get out of the forensic testing business altogether, noting that backlogs exist not only in DNA but also in the ballistics and fingerprints divisions. “At a bare minimum, the whole process of forensic testing — old cases or new cases — has to be removed over to some responsible entity and, given the track record of HPD, they’re not the ones to do this,” said Jeff Blackburn, general counsel for the Innocence Project of Texas. “They just can’t clean [more...]

Two More Innocent Men Released in Texas as Critical Reforms Wait ...

Even prior to the latest exonerations in Houston, Texas already led the nation with 40 wrongful convictions exposed by DNA evidence, and in the span of a week two more wrongfully convicted men were freed based on DNA testing and other evidence of innocence. These two most recent cases are painful reminders of how slowly Texas has been to implement reforms that can prevent such horrible injustices. Texas cannot do without eyewitness evidence, so it is essential that steps be taken that are necessary to make sure that evidence is as accurate as possible. No reforms can guarantee that mistakes [more...]

Innocence Blog: Houston Man Free After 23 Years

Posted: August 7, 2009 2:46 pm Innocence Project client Ernest Sonnier is free today after more than two decades in Texas prisons for a rape he didn’t commit. DNA testing has proven Sonnier’s innocence of the 1985 attack and implicated two other men. Sonnier was freed on bond today by a Texas judge while he continues seeking to fully clear his name in the weeks ahead. His mother, Altha Davis, told reporters that she always knew he was innocent because he was with her when the crime was allegedly committed – on Christmas Eve 1985. “It’s been long for me, so long,” she said. HOUSTON-HARRIS COUNTY NEEDS AN EMERGENCY DNA LAB

Equally significant is the possibility that the testing of the DNA samples could lead to the exoneration of yet another wrongfully convicted person. There have been a total of 255 DNA exonerations in this country with Texas leading the nation in wrongful convictions. It has about one-fifth of all the nation’s DNA exonerations. The HPD crime lab backlog – Off the Kuff

County officials are developing cost estimates for an interim DNA lab to do the testing for the county and city, and have proposed a vacant 20,000-square-foot lab in the Medical Center. The testing could begin in six months at an estimated cost of $20 million a year. Where’s Harris County going to find the money to pay for that? You can blame the city of Houston for this if you’d like, but the same question applies. Right now, at every level of government, we don’t have the money to pay for the things we want. It’s easy to talk about cuts, but stuff like this is the consequence. Until [more...]

Chromosal Laboratories, a DNA testing lab in Phoenix, Ariz., has told Gov. Rick Perry that it will test evidence in the Hank Skinner case for free and within 30 days if he grants a reprieve of the convicted murderer's March 24 execution date. Skinner was convicted in 1995 of murdering his girlfriend and her two sons in the small West Texas town of Pampa. He has professed his innocence, though, and Skinner argues that DNA testing on a rape kit, knives, a man's windbreaker and other materials from the crime scene could prove someone else was the killer. Technology Review: A Genetic Christmas Story

Some people may have received an unusual gift this holiday season: an ancestry testing kit that uses a small swab of DNA to shed light on near and ancient family history. It sounds, at first, like a novelty item. But the kit may provide long-term assistance to scientists who are hoping to track the history of the human race. In one project, spearheaded by National Geographic Society and IBM, participants buy a kit for $99.95, scrape some skin cells from the inside of their cheek, and send the samples in for analysis. Once the DNA is processed, participants learn their haplogroup -- the [more...]
