Fight Over Child Support and DNA Testing in Dallas County Court ...

Courthouse News this morning highlights the story of Ginger Weatherspoon, a former assistant attorney general in Greg Abbott's office who claims she was fired after refusing to lie under oath about 254th District Judge David Hanschen. Weatherspoon, who worked from July 2006 through February '08 in the the Office of the Attorney General's child support division, has filed a nine-page whistleblower suit in Dallas County District Court in which she claims she was fired for telling her direct superior that two other attorneys pressured her, repeatedly, to sign "a false affidavit" that said [more...]

Dallas DNA « The Reality-Based Community

The Discovery Channel now has a documentary series based on the unit of the Dallas County DA’s office that does its own investigations of possibly innocent people in prison, rather than stonewalling demands for DNA checks as so many prosecutors’ offices do. The unit is a transparently good idea, and every major DA’s office ought to have one. If I were a Governor or a state Attorney General, I’d establish a statewide office to boot; Eric Holder might consider creating a similar unit within the Justice Department (to cover state as well as federal prisoners). The exoneration of the [more...]

SCOTUS BLOG Part #3: Inside Texas–Dallas D.A. “without a doubt” would test DNA evidence "...  It seems that in the pursuit of truth, like real estate, location is everything.  Had convicted murderer Henry Skinner requested post-conviction DNA testing in Dallas instead of Pampa, where the triple homicide occurred, the Supreme Court would not be hearing arguments in Skinner v Switzer this Wednesday — or any other time. Editorial: Test all DNA in Skinner case | Explore The Law

Rape victims involved in 20 Dallas County DNA exoneration cases know that. At one point, they thought they could go on with their lives knowing justice had been done, but it really hadn't been. Opponents of Texas' 2001 law providing access to DNA said the courts already had what they needed to deal with potential cases of miscarriage of justices, a position that looks silly today. It's possible that Skinner is as guilty as the West Texas sky is blue. Texas courts say they're sure of it. But they don't have all the facts, and there's no excuse not to have them. Brodie is the third man in Dallas County cleared without DNA evidence and the second exonerated after pleading guilty to a crime. He is also the second exoneration in a Richardson case . The county has recorded 20 DNA exonerations – more than any other county in the nation since 2001, when Texas began allowing post-conviction genetic testing. Eight of those exonerees showed up to greet Brodie on Tuesday and gave him several hundred dollars. Thomas McGowan, the other man exonerated in a Richardson case, said he came to let Brodie know he wouldn't be going through his readjustment alone. [more...]

Claude Howard Jones was executed a decade ago. But a DNA test is now going to be conducted to determine whether a 1-inch hair that was relied on to convict him of capital murder was actually his. A retired Texas appellate judge hearing a Dallas case seeking to prove that Jones was wrongfully convicted ruled Friday that the DNA test would be performed, despite opposition from the San Jacinto County District Attorney's office. which argued that a jury verdict should be final, reports the Associated Press. Sequenziamento del DNA- Prima generazione (metodo Sanger) « my GenomiX

Esse si [more...]

Chromosal Laboratories, a DNA testing lab in Phoenix, Ariz., has told Gov. Rick Perry that it will test evidence in the Hank Skinner case for free and within 30 days if he grants a reprieve of the convicted murderer's March 24 execution date. Skinner was convicted in 1995 of murdering his girlfriend and her two sons in the small West Texas town of Pampa. He has professed his innocence, though, and Skinner argues that DNA testing on a rape kit, knives, a man's windbreaker and other materials from the crime scene could prove someone else was the killer. For a decade, Texas courts have denied [more...]

Mother of All Humans Lived 6000 Years Ago

Further, for so few--only 21.6 nucleotides out of 16,569--DNA differences to have accumulated at anything near the measured mutation rates, a much shorter time than "200,000 years" must have transpired since Mitochondrial Eve arrived on the scene. To stretch out across evolutionary time the occurrences of so few DNA changes requires a gymnastic juggling of the coefficients used in the various models, and appears to require a biologically unrealistic, super-slow mutation rate. Making the data fit vast timescales requires the use of a broken, circular-reasoning-based, evolutionary [more...]
