Northern Law Blog: Voluntary Acknowledgments of Paternity
On May 1, 2007, my client signed a voluntary acknowledgment of paternity ("VAP"). The mother of the child had convinced him at that time that he was the father. Recently, certain comments made by the mother have led my client to believe that he was not the father. So, he took the child to the clinic for a paternity test. Case Law Update: Voluntary Acknowledgement Wins in Competing ...
In an extremely messy case involving dramatically differing stories from the parties and the intersection of four separate statutory provisions governing paternity, the California Court of Appeals held that a voluntary acknowledgment of paternity trumped the presumption created by holding oneself out as a father. While she was pregnant and for a time after the child was born, Mother lived with the petitioner, a man (who happened to be a family law attorney) . Illinois First District Appellate Court DATE Date filed March 31, 2009 Because the biological mother and biological father witnessed each other’s signature, the acknowledgment was not properly executed and paternity was not established. And because the biological father did not commence legal proceedings within 30 days of registering with the Putative Father Registry, his paternity was also not established. Therefore, the adoption of the child could proceed without intervention by the biological father. To correctly execute an Illinois Voluntary Acknowledgment of [more...]

By TDOM Paternity Fraud and Reproductive Freedom The first article in this series (Legally Obscene) identified the injustice of forcing male victims of rape and statutory rape to pay child support to the women who raped them and became pregnant and produced children as a result. Tips, tricks and informational articles about all the things we face in life as parents Establishing Paternity In layman’s language, paternity is essentially being a father or fatherhood. If an unmarried couple has a child, state laws do not necessarily recognize the man as the legal, biological father. Establishing paternity is to take legal action to claim fatherhood. Benefits With the legal establishment of paternity, a father can now have a social, [more...]
