Carnell Smith of Georgia founded U.S. Citizens Against Paternity Fraud in 2001 after his own struggle. When his daughter turned 11, Smith had a paternity test as part of a child support modification case. Years before, he had believed his ex-girlfriend when she told him she was pregnant with his child. He was wrong. Smith's organization has succeeded in getting laws passed in Georgia and Ohio to address the situation. The idea is that a man who steps up to care for a child based on a mistake should never be punished for doing so. The current law encourages fathers to protect themselves by [more...]

Paternity fraud in Colorado (Thanks Rep. Gardner!) « www ...
Paternity fraud in Colorado (Thanks Rep. Gardner!) May 2, 2008 by Doug Parris It is an ancient principle that it is in the best interest of a child to have paternity established and left undisturbed by the courts. Insofar as practical that principle should be obeyed. But that principle was formed on the basis that children were almost always born within a marriage, and that the couple would raise the child together. Obviously that is no longer true but in support of that principle Colorado law at present makes it impossible for a divorced man, or an unmarried man against whom a paternity [more...]

No-one knows the rate of paternity fraud in the general population. A paper in the respected journal Science reports one molecular geneticist who says that U.S. labs screening for inherited disease expect to find about 10% of children tested as being fathered by someone other than the one thought to be their Dad. One paper found and examined seventeen studies that provide enough information to be able to identify paternity fraud. The authors found that the estimates range 0.8% to 30% with a median value of 3.7%. So it is probably reasonable to assume that the actual rate of paternity fraud [more...]

Immigration testing has become simpler, faster and more accurate thanks to DNA testing. It comes down to a simple question, can you prove that you are related to someone who is currently a citizen of that country? It is not uncommon that a parent would come to the United States and work for many years sending money home to take care of the children and family members. As far as the amnio or in-vitro…this can be harmful to the baby and isn’t a good idea. She needs to wait till after the baby is born. These techniques are considered highly invasive. On May 1, 2007, my client signed a voluntary acknowledgment of paternity ("VAP"). The mother of the child had convinced him at that time that he was the father.
